Further question on DPM.

There seems to be a complaint files with the Ontario Securities Commission (OSC) over DPM failure to disclose material information to its shareholders about serious legal threats related to an ongoing court-ordered suspension of its Loma Larga mining project in Southern Ecuador.

This seems rather serious for the company.

Do you consider this a material blocker to investing in DPM or rather just an legacy issue from a previous owner of the mine and DPM is OK to consider buying?

A submission dated August 12, 2025 by law professor Shin Imai, on behalf of MiningWatch Canada and multiple Ecuadorian partners, asks the OSC to investigate whether DPM misled investors by downplaying or omitting the scope and duration of court‑ordered suspensions and legal risks affecting Loma Larga. The filing focuses particularly on a July 7, 2025 DPM press release, arguing it did not adequately flag that ongoing Ecuadorian court proceedings could result in multi‑year delays or even permanent closure of the project. Local legal challenges in Ecuador led to a court‑ordered suspension of Loma Larga in 2022, initially described by DPM as a “pause” tied to a constitutional protective action concerning consultation and water impacts. Subsequent decisions, including confirmation by higher courts up to the Constitutional Court of Ecuador in early 2024, have meant the suspension has effectively remained in place for several years while issues around Indigenous consultation and drinking‑water protection are litigated. So, while DPM may not have been perfect in its reporting of the situation, the mine is still suspended and DPM has stopped exploration. We would thus not consider it a material event and it would not prevent us from buying.
